Terms of Service

 

These Terms of Service (“Terms”) govern your use of the Legacy Photo Lab website, mobile application, customer account features, retail services, film-processing services, scanning services, digital-delivery services, and other products or services offered by us (collectively, the “Services”).

Legacy Photo Lab is owned and operated by Omni Photo Services LLC. In these Terms, “Legacy Photo Lab,” “Legacy,” “we,” “us,” and “our” refer to Omni Photo Services LLC.

By accessing or using our Services, purchasing products or services from us, submitting film or other media to us, creating or accessing a customer account, or accepting these Terms through our mobile application, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use the Services.

1. Eligibility and Customer Information

You must be legally capable of entering into an agreement with us, or use the Services with the permission and supervision of a parent or legal guardian.

You agree to provide accurate and current information when placing orders or using your customer account, including your email address, telephone number, billing information, shipping information, and other information reasonably required to provide the Services.

You are responsible for maintaining access to the email address associated with your Legacy Photo Lab account.

2. Orders and Payment

Prices, product availability, processing options, turnaround estimates, promotions, and other service details may change from time to time.

We may refuse, limit, cancel, or refund an order when reasonably necessary, including because of product availability, payment issues, suspected fraud, order errors, technical problems, or circumstances that prevent us from completing the requested service.

Purchases made through our online store may be processed using Shopify and third-party payment providers. Payment information is handled subject to the policies and security practices of the applicable payment provider.

Our applicable Refund Policy is incorporated into these Terms by reference.

3. Film Processing, Scanning, and Photographic Services

Film development, scanning, printing, restoration, digitization, and related photographic services involve physical materials, chemical processes, imaging equipment, software, and human handling.

Results may vary because of factors including:

  • film age or condition;
  • exposure;
  • camera or equipment malfunction;
  • light leaks;
  • improper storage;
  • prior handling or processing;
  • damaged or expired film;
  • chemical or manufacturing defects;
  • image density;
  • customer-selected processing or scanning options; and
  • characteristics inherent to analog photography and scanning.

We cannot guarantee that submitted film contains usable images or that every frame will produce a satisfactory image.

Differences in color, density, contrast, cropping, sharpness, grain, dust, or other visual characteristics may occur between physical film, scans, prints, displays, and other reproductions.

Turnaround times are estimates unless we expressly state otherwise.

4. Risk to Original Film and Physical Media

We understand that original negatives, film, photographs, slides, tapes, and other submitted materials may be unique or personally valuable.

We take reasonable care when handling customer materials. However, photographic processing and physical handling involve unavoidable risks, including loss, damage, deterioration, equipment malfunction, shipping damage, processing failure, or other events that may affect submitted materials.

You should not submit materials if the possibility of loss or damage is unacceptable to you.

To the fullest extent permitted by applicable law, our liability for accidental loss of or physical damage to submitted film or media will not include sentimental, artistic, historical, speculative, or consequential value.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

5. Your Photographs and Content

You retain ownership of photographs, images, film, scans, and other content that you submit to us.

By submitting content to Legacy Photo Lab, you grant us limited permission to possess, handle, process, scan, reproduce, store, transmit, and otherwise use that content solely as reasonably necessary to:

  • perform the Services you requested;
  • create and deliver scans or prints;
  • maintain your customer account and order history;
  • provide customer support;
  • troubleshoot technical or service problems;
  • protect the security and integrity of our systems; and
  • comply with applicable law.

This permission does not transfer ownership of your photographs to Legacy Photo Lab.

We will not use customer photographs for advertising, social media, promotional materials, or other unrelated commercial purposes without permission, except where otherwise permitted by law.

You represent that you have the right to submit the content you provide to us and that our processing of it as requested by you will not violate applicable law or the rights of another person.

6. Digital Scans and File Availability

When scanning is included in your order, digital files may be delivered or made available through the Legacy Photo Lab mobile application, website, download system, email, or another delivery method.

Digital scans are intended to remain available for download for at least 30 days after they are made available to you.

You are responsible for downloading your scans and maintaining your own backup copies during that period.

We may retain scans for longer than 30 days, but continued availability after the initial 30-day period is not guaranteed.

After the 30-day availability period, scans may be permanently deleted and may not be recoverable.

The fact that a scan remains accessible after 30 days does not create an obligation for Legacy Photo Lab to continue storing that file.

We may offer optional extended or premium storage services in the future under separate pricing or terms.

7. Digital Storage and Data Loss

We use commercially reasonable systems and service providers to store and deliver customer files, but no digital storage or transmission system can be guaranteed to be completely uninterrupted or free from failure.

Temporary outages, network failures, corrupted files, software errors, third-party service interruptions, security incidents, or other technical problems may occasionally affect access to digital files.

Customers should download and independently back up important scans.

Where reasonably possible, we will attempt to correct delivery or storage issues affecting files that remain within our systems, but we do not guarantee that every lost or corrupted digital file can be restored.

8. Legacy Photo Lab Mobile Application

The Legacy Photo Lab mobile application may provide features including:

  • passwordless account access;
  • order information;
  • film-processing status;
  • scan galleries;
  • digital downloads;
  • notifications;
  • location preferences;
  • rewards or loyalty features;
  • photography tools such as a light meter; and
  • links to Legacy Photo Lab products or services.

Some features depend on internet connectivity, third-party systems, device settings, or external service providers.

Status information and notifications are provided for convenience. A delayed, missing, or incorrect notification does not necessarily reflect the actual physical location or processing state of an order.

We may add, modify, suspend, or discontinue application features from time to time.

9. Customer Accounts and Security

Customer accounts may use email verification codes, session credentials, device credentials, or other authentication methods.

You are responsible for protecting access to your email account and device.

You should notify us promptly if you believe someone has gained unauthorized access to your Legacy Photo Lab account.

We may terminate sessions, restrict access, or take other reasonable security measures when we suspect unauthorized use, fraud, abuse, or a threat to the Services.

10. Account Deletion

Where available, you may request or initiate deletion of your Legacy Photo Lab account through the mobile application or by contacting us.

Deleting an account may remove or disconnect certain account information and access to digital files.

You should download any scans you wish to keep before deleting your account.

Certain information may be retained where reasonably necessary for legal compliance, financial records, fraud prevention, dispute resolution, security, or other legitimate business purposes, as explained in our Privacy Policy.

11. Communications, Text Messages, and Push Notifications

By providing a telephone number, email address, or enabling notifications in the Legacy Photo Lab app, you agree that Legacy Photo Lab may contact you regarding transactions and services associated with your orders or account.

These communications may include:

  • order confirmations and updates;
  • film-processing status;
  • notifications that scans are ready;
  • pickup reminders;
  • unclaimed-order or abandoned-order notices;
  • shipping or delivery information;
  • account and security messages;
  • customer-service communications; and
  • other service-related notices.

Transactional text messages may be sent to the telephone number associated with your order or customer account. Message and data rates may apply depending on your wireless carrier and plan.

Push notifications may be sent through the Legacy Photo Lab mobile application when you have enabled notification permissions. You may disable push notifications at any time through your device settings.

Operational and transactional communications are separate from promotional marketing communications. If Legacy Photo Lab offers promotional text-message marketing, any required marketing consent and opt-out process will be handled separately.

You are responsible for keeping your contact information current and for notifying us if a telephone number or email address associated with your account changes.

12. Shipping, Pickup, and Third-Party Carriers

When products, film, negatives, prints, or other materials are shipped, transportation may be performed by third-party carriers.

Shipping and delivery estimates are not guarantees.

Risk associated with third-party transportation may be subject to the carrier's terms and applicable law.

Customers are responsible for providing accurate shipping and contact information.

Additional policies may apply to orders that remain unclaimed or uncollected after completion.

13. Prohibited Uses

You may not use our Services:

  • for an unlawful purpose;
  • to violate another person's intellectual-property, privacy, or other legal rights;
  • to transmit malware or malicious code;
  • to attempt unauthorized access to our systems or another customer's account or files;
  • to interfere with the security or operation of our Services;
  • to scrape or systematically extract protected customer or business data without authorization;
  • to impersonate another person; or
  • to engage in fraud or other abusive activity.

We may restrict or terminate access for conduct that violates these Terms or creates a security or legal risk.

14. Third-Party Services

Our Services depend in part on third-party providers that may provide e-commerce, payments, hosting, storage, communications, analytics, notifications, shipping, or other functionality.

Those providers may operate under their own terms and privacy policies.

We are not responsible for third-party websites or services that are outside our control, although we choose and use service providers as reasonably necessary to operate Legacy Photo Lab.

15. Intellectual Property

Except for customer content and materials owned by third parties, the Legacy Photo Lab name, application, website, software, design elements, graphics, text, branding, and other content provided through our Services are owned by or licensed to Omni Photo Services LLC and are protected by applicable intellectual-property laws.

These Terms do not grant you ownership of Legacy Photo Lab intellectual property.

16. Service Availability

We work to keep the Services available and functioning properly, but we do not guarantee uninterrupted or error-free operation.

We may temporarily suspend or limit some or all of the Services for maintenance, upgrades, emergencies, security reasons, third-party outages, or other operational reasons.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis except for warranties that cannot legally be excluded.

We do not guarantee that digital systems will always be available, that every submitted roll will contain usable photographs, that all files can be recovered after a failure, or that photographic results will precisely match a customer's expectations.

Nothing in these Terms limits any warranty or consumer right that cannot lawfully be waived.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Omni Photo Services LLC, doing business as Legacy Photo Lab, and its officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the Services, including loss of profits, loss of opportunity, or loss of data.

For claims involving an affected product or paid service, our aggregate liability will not exceed the amount paid to Legacy Photo Lab for the product or service giving rise to the claim, except where applicable law requires a different remedy or does not permit such a limitation.

For loss of or physical damage to customer film or other original media, any limitation in these Terms is subject to applicable law and does not apply to liability that legally cannot be excluded or limited.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Omni Photo Services LLC, doing business as Legacy Photo Lab, and its officers, employees, and agents from third-party claims arising from:

  • content you submit without the necessary rights or permission;
  • your unlawful use of the Services;
  • your material violation of these Terms; or
  • your violation of another person's rights.

This section does not require you to indemnify Legacy Photo Lab for conduct for which indemnification cannot legally be required.

20. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

Our Privacy Policy explains the categories of information we collect, how we use and protect information, how customer scans are handled, our use of service providers, retention practices, and customer privacy choices.

21. Changes to These Terms

We may update these Terms as our Services, technology, business practices, or legal obligations change.

The current version will be published on this page with its effective date.

For material changes, we may provide additional notice or require customers to accept an updated version before continuing to use certain Services.

22. Termination

You may stop using the Services at any time.

We may suspend or terminate access to the Services where reasonably necessary because of a violation of these Terms, fraud, unlawful activity, security concerns, abuse, or discontinuation of a Service.

Provisions that by their nature should survive termination, including provisions regarding ownership, limitations of liability, and disputes, will remain effective.

23. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the greatest extent permitted by law and the remaining provisions will remain in effect.

24. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and any other policy expressly incorporated into a particular purchase or service, constitute the agreement between you and Omni Photo Services LLC regarding the applicable Services.

25. Governing Law

These Terms and the Services are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law provides otherwise.
